2. About Modensa Design Consultancy
Modensa Design Consultancy is a fashion and streetwear design consultancy business, ABN 64 629 087 417.
3. Deposit, Cancellation Fee, Outstanding Payments
3.1 Upon confirmation by you that you require Modensa Design Consultancy to carry out design work on your behalf, we require payment of a deposit of 50 per cent (50%) of the amount quoted for completion of your work to be paid prior to any work being commenced, which is non-refundable in the event that our agreement is terminated by you.
3.2 In the event that our agreement is terminated by Modensa Design Consultancy and the deposit for work as referred to in clause 3.1 above has been paid by you, Modensa Design Consultancy will retain as payment from that deposit an amount equal to the value of any work carried out and will refund you any remaining balance of the deposit you have paid.
3.3 Invoices outstanding for more than 60 days will incur the full cost of any debt recovery action, fees or legal costs incurred by Modensa Design Consultancy, with such costs forming part of the principal debt.
4. Refund Policy for Design and Development Services
All fashion designs and development work carried out by Modensa Design Consultancy will be carried out only upon full payment of a deposit as specified in clause 3.1 above. All clients must acknowledge that they have read these Terms of Service. This acknowledgement is deemed a legal contract between both parties. Any amendments to our standard Terms of Service and our refund policy must be negotiated and agreed to by both parties in writing prior to commencement. Modensa Design Consultancy may choose to honour a whole or part of a refund request in some cases and will do so at our discretion.
